In California, a misdemeanor is a criminal offense where the maximum penalty is no more than 364 days in county jail and a fine of not more than $1,000. Misdemeanors are less serious than felony crimes and do not carry the potential to be sentenced to a California state prison. Some common standard misdemeanor crimes in California include assault, battery, indecent exposure, petty theft, shoplifting, and disturbing the peace. Some common "aggravated" misdemeanors include domestic battery, stalking, and DUI. Misdemeanor sentences can provide for probation only, a fine, or some community service time. There are a few misdemeanors that have fines up to $2,000. It should be noted that this list does not include all California misdemeanors.
