Abortion is legal in Florida, but there are restrictions on abortion access. As of September 2023, Florida law generally prohibits abortion at fifteen weeks LMP (last menstrual period) . On April 13, 2023, Florida enacted a six-week ban on abortions. Pregnant people who seek abortion care must undergo a twenty-four-hour mandatory waiting period, biased counseling, and an ultrasound. They must also provide a copy of a restraining order, police report, medical record, or other court order or documentation providing evidence that they are obtaining the termination of pregnancy because they are a victim of rape, incest, or human trafficking. If the person is under 18 years of age, Florida state law requires most young people under 18 to involve a parent or legal guardian in their decision. However, there is a judicial bypass option for those who cannot safely get permission from their parents to have an abortion.
