The hazardous materials exempt from WHMIS (Workplace Hazardous Materials Information System) include:
- Explosives as defined in the Explosives Act
- Cosmetics, devices, drugs, or foods as defined in the Food and Drugs Act
- Pest control products as defined in the Pest Control Products Act
- Consumer products as defined in the Canada Consumer Product Safety Act
- Wood or wood products
- Tobacco or tobacco products as defined in the Tobacco Act
- Nuclear substances that are radioactive as defined in the Nuclear Safety and Control Act
- Manufactured articles (products shaped or designed to specifications that do not release hazardous products under normal use)
- Hazardous waste (hazardous products sold for recycling/recovery or intended for disposal)
While these products are exempt from WHMIS labeling and Safety Data Sheets (SDS), employers must still provide education and training about their hazards, safe use, and storage since some may still be hazardous under other legislation.
